Meeting: Regular Council Meeting
Date: September 23rd, 2020
Place: Davis Town Hall
Mayor Martin called the meeting to order at 6:30pm
Roll Call; Mayor Martin, Council; Ted Helmick, Lisa Cousin, John Felton, Al Tomson, Cindy Robeson and Recorder Snyder.
Absent: None
Pledge of Allegiance
Guests: Jeanette Tekavec Ware, Heather Clower, Pete Johnson, Eric Cvechko, Michael Cvechko, Nanette Seligman, Robin & Michael McClintock.
Minutes from September 9th, 2020 Council Meeting: Councilman Tomson made a Motion to approve, Councilman Felton Second, all in favor, Motion carried.
Dispense from Regular Order of Business: Councilman Helmick Moved, Councilman Tomson Second, all in favor, Motion carried.
Guests: Nanette Seligman reported that she located the stolen artwork from the ‘533’ (old Shop ‘n Save) exterior. She reported it to the Tucker County Sheriff Department and was told to “Go get it”. She was disappointed in the lack of effort on behalf of Sheriff’s office. Pete Johnson presented his plans for a development on his property at Davis Riverwalk, that will include residential, retail and recreation use. He is looking to build his house between now and April 1, 2021. Mayor Martin asked if Mr. Johnson had used the most recent Flood Plain Revision Map. Mr. Johnson said he will seek to obtain that. Eric Cvechko of Capon Bridge, said that he and his brother Mike Cvechko, are interested in the lot just east of the Blackwater Bikes Building for a 6-unit Air B & B and 2,500 square feet of retail space.
Return to Regular Order of Business, Councilwoman Cousin moved to return to Regular Order of Business, Councilman Helmick Second, all in favor, Motion carried.
Committee Reports:
Finance: Mayor Martin presented accounts payable for review.
Streets, Alleys, Water Works: Jobs Completed from 9/16/2020 through 9/19/2020, See attached list.
Personnel: Vacation Request for Town Employee Jay Kennard from 10/5/20 to 10/9/20. Recorder Snyder Moved, Councilman Helmick Second, all in favor, Motion carried.
Mayor Martin called for a Motion for Council to go into Executive Session. Councilman Helmick made a Motion, Councilman Tomson Second, all in favor, Motion carried.
Mayor Martin asked for a Motion to return to Regular Order of Business from Executive Session. Councilman Tomson made a Motion, Councilwoman Robeson Second, all in favor, Motion carried. No action was taken during Executive Session.
Ordinance/Resolution: Mayor Martin presented an updated list for Cemetery Rules for Burials. Discussion followed. It was suggested that Council table until the 10/14/20 regular meeting. Recorder Snyder Moved, Councilman Tomson Second, all in favor, Motion carried.
Cemetery: None
Parks and Recreation: All Park facilities stilled closed due to Covid-19. A Christmas Decorating Contest was suggested for this year. (See attached) Discussion was tabled until the 10/14/20 regular meeting.
Old Business: None
New Business: Tina Wood, Water Clerk for the Town, recommends a new computer purchase to accommodate new water billing software (Computer driver is old and slow). Councilman Tomson Moved, Councilman Helmick Second, all in favor, Motion carried. Municipal Garbage Service: All Residential Customers located in the Municipality must pay for Garbage Service. Discussion followed. Motion made by Councilman Helmick, Second by Councilman Felton, all in favor, Motion carried. Trick or Treat: The Tucker County Health Department and the Center for Disease Control have recommended not having Door to Door Trick or Treating. Councilman Tomson Moved that Council table the issue until the 10/14/2020 meeting. Councilwoman Robeson Second, all in favor, Motion carried.

Mayor Martin asked for a Motion to Pay the Bills. Councilman Tomson moved, Councilman Felton Second, all in favor, Motion carried.
